CHRISTMAS AT THE FARM HOLD HARMLESS AGREEMENT & REGULATIONS *

I understand that the conduct of the exhibit in my assigned area, as well as the security of those items brought to my assigned space, or any other space, is entirely my responsibility. I understand that the role of Christmas at the Farm, herein referred to as CATF, is to provide exhibit space and to attract customers to the event. I will not hold Meyer’s Tails Up Farm, Gwen/Kent Meyer responsible for any loss, personal injury or damage to my property or my persons or to anyone else or their property. I agree to the following regulations and understand that the violation of any of these regulations may mean the immediate forfeiture of my privilege of exhibiting and/or selling my work without refund of my fee or recourse against hold Meyer’s Tails Up Farm, Gwen/Kent Meyer. I recognize the right of CATF or its designee to enforce these regulations and be the final word of any disputes. Meyer’s Tails Up Farm, Gwen/Kent Meyer will not be liable for refunds of booth fees or any other liabilities whatsoever for the failure to fulfill this contract due to weather, fire or other calamity, or by any act of God, public enemy, strikes, statutes, ordinances, or any legal authority, or any cause beyond its control.  Vendors found in violation of any of the items in this contract may be excluded and have their exhibits removed from the current and /or future markets at the sole discretion of CATF. No refunds will be provided. Refunds will be provided if the show must be cancelled due to Covid-19. Under no circumstances, including negligence, shall CATF be liable for any direct, indirect, incidental, special or consequential damages resulting from such action.  The undersigned exhibitor agrees to hold harmless and indemnify Meyer’s Tails Up Farm, Gwen/Kent Meyer and any authorized agents thereof from and against any and all claims, loss, damage to any property on or at the location of the CATF to which this agreement relates and arises out of any act or omission of the exhibitors, or any of its agents or employees. Exhibitors also agrees to use due and reasonable care to keep the area of the exhibitor’s station neat, orderly and free from foreseeable hazards to persons or property. Exhibitors agree that he/she shall be solely responsible for any damage, loss or theft of any display items which are the property of the exhibitor and further agrees that Meyer’s Tails Up Farm, Gwen/Kent Meyer will not be responsible for any such loss, damage or theft of the items or property of the exhibitor at the location.  Exhibitors further agree to abide by and follow all rules and regulations of CATF committee.  Attendance as an exhibitor is deemed to be acceptance of these conditions.   This contract shall be deemed to have been made in the State of Illinois and shall be interpreted in accordance with the laws of such state. In the event that legal action is required to enforce this contract or any of the terms thereof, such action shall be brought in the courts of Boone County, Illinois, and the vendor expressly consents to the jurisdiction of such courts. The parties agree to accept service of process in such action by ordinary mail sent to their business address.
